Title Searches

In all instances we advise a title search for the following reasons:

  • Ensure ownership at closing
  • Ensure property parties sign the deed
  • Reveal matters to address at closing such as open mortgages, liens, judgments, and ownership issues
  • Try to ensure that buyers get what they bargain for based on our understanding of the transaction
  • Reveal  matters the seller needs to address prior to closing that might affect ownership and enjoyment of the property - these can include but are not always revealed by a title search

Title searches also reveal relevant documents affecting use of property, including:

  • Easements for access
  • Well agreements
  • Driveway agreements
  • Party walls
  • Restrictive covenants


We always recommend obtaining a survey. They are valuable in helping us best determine the effects that certain issues will have on a Buyer's use and enjoyment of the property that are only revealed by a current survey. These may

Mobile Homes and Manufactured Housing

Considerations when buying a manufactured home include:

  • Special requirements apply to mobile homes and manufactured housing
  • We do DMV title checks when we are advised that a home is manufactured housing to ensure homes are properly titled and clear of liens
  • Manufactured homes may need to have a cancellation of titles to real estate
  • Whether covenants permit the placement of a manufactured home
  • Whether a manufactured home should be titled

Financed and Cash Closings

We routinely work with both cash closings and a variety of loan types including conventional, FHA, USDA, VA, Seller Financed, 203K, Equity Lines, and Subordinations.  As part of this service, we:

  • Review loan packages to try to ensure signed packages are error-free after closing
  • Conduct a post-close review to help reduce the need to re-sign documents
  • Attempt to advise of certain lender requirements or property requirements to you or your agent that might delay closing if not addressed in a timely manner
  • E-record in many North Carolina counties to ensure quicker recording and enable 24-hour return of deed
  • Issue preliminary opinions and final opinions as well as procure title insurance. We are approved attorneys for the following insurers: Investor’s Title, Old Republic, First American, Chicago Title, Stewart Title, WFG, and Fidelity National Title
  • Strive to provide settlement statement prior to closing (pending package availability and approval from lender)
